EzyMove Terms

The EzyMove scheme is offered by Allison Homes Group Limited and applies to selected plots and developments only, subject to status and availability. The scheme is intended to assist purchasers who have an existing property to sell.

Eligibility and initial process

To be considered for the EzyMove scheme, you must provide access to your existing property within three working days of request to enable inspections and valuations to be carried out by estate agents or other professionals appointed by us. You must also provide any information reasonably requested, including an Energy Performance Certificate where available.

Following receipt of at least two valuations and an inspection of your property, we will confirm the proposed marketing price and acceptable price range. You must confirm your acceptance within two working days. If you do not accept the proposed pricing, your application will be cancelled.

We reserve the right to determine, in our sole discretion, whether a property is suitable for inclusion in the EzyMove scheme and may decline any application.

Reservation and marketing arrangements

Once the marketing price is agreed and you have been accepted onto the scheme, your chosen new build plot may be reserved and removed from general marketing for a period agreed with your sales adviser, subject to the terms of your Reservation Agreement and completion of any required anti money laundering checks.

You agree that we will appoint one or more estate agents to market your existing property and that you will not appoint any alternative agents or interfere with the terms of their appointment. You must cancel any existing agency agreements at your own cost and we will not be responsible for any fees or liabilities arising from those arrangements.

You agree to co-operate fully with the appointed estate agents and to allow reasonable access for viewings, marketing activity and the erection of a for sale sign. You must ensure the property is presented in a clean, tidy and saleable condition at all times.

You agree to notify us promptly, and in any event within one working day, of any offers received directly or through any third party.

Marketing period and price reviews

The marketing period will be agreed at the outset and recorded in the EzyMove agreement or Reservation Agreement. If an acceptable offer is not received within this period, we reserve the right to require a reduction in the marketing price. If you do not agree to any revised marketing strategy or price, we may withdraw the scheme and remarket the new build property.

If your property remains unsold at the end of the agreed marketing period, the EzyMove arrangement will terminate and the new build plot may be released for sale.

Offer acceptance and exchange

Upon acceptance of an offer on your existing property, you must instruct your solicitor immediately and use all reasonable endeavours to exchange contracts within the period specified in your Reservation Agreement, which will typically be 42 days.

The purchase of your new Allison home is subject to you proceeding to exchange and completion of your related sale within agreed timescales.

Estate agent fees and costs

We will pay the estate agent’s commission and VAT in connection with the sale of your property provided that you proceed to legal completion of your purchase of the new Allison home.

If you withdraw from the purchase, or fail to complete for any reason, and you subsequently sell your property to a purchaser introduced by the estate agent appointed under the EzyMove scheme, you will be responsible for all estate agent fees and associated costs.

We will not be liable for any fees, costs or charges incurred prior to the commencement of the EzyMove arrangement, including those arising from previous estate agent instructions.

Withdrawal and termination

If you withdraw from the EzyMove scheme or from the purchase of your new home, the Reservation Agreement will apply to determine whether your reservation fee is refundable.

We reserve the right to withdraw the EzyMove scheme at any time prior to reservation or if you fail to comply with these terms, or if your property becomes unsuitable for sale for any reason, including adverse survey findings or title issues.

Property condition and completion

You must maintain your existing property, including any garden, outbuildings and fixtures, in a clean and tidy condition until legal completion. Full vacant possession will be required on completion.

Failure to maintain the property to an acceptable standard may affect your participation in the scheme or require remedial action at your cost.

General

All offers and arrangements under the EzyMove scheme are subject to contract, status and availability and may not be used in conjunction with any other offer unless expressly agreed in writing.

We are not responsible for any delay or failure in the sale of your property, including where this arises from market conditions, buyer behaviour, mortgage availability or issues identified in surveys or legal due diligence.

These terms are supplemental to and must be read in conjunction with your Reservation Agreement, which shall prevail in the event of any inconsistency.
